These terms form part of Sopal’s Terms of Use and Account Terms. By accessing or using the Nominating Authority Statistics, you agree to these terms.

1. Scope and incorporation

These Nominating Authority Statistics Terms apply to the page at sopal.com.au/nominating-authorities, related charts, tables, exports, descriptions and any other Sopal feature presenting statistics grouped by a nominating authority or by an adjudicator’s association with a nominating authority (the Statistics).

These terms apply in addition to Sopal’s Terms of Use, Account Terms, Subscription Terms and Privacy Policy. If there is an inconsistency concerning the Statistics, these terms prevail to the extent of the inconsistency.

These terms, together with the documents they incorporate, constitute the entire agreement concerning the Statistics and supersede all prior or contemporaneous representations, statements, descriptions and understandings relating to their subject matter.

2. Nature of the data

The Statistics are derived from published Queensland adjudication decisions and associated extracted data. The underlying decisions were prepared for particular disputes and may contain omissions, errors, inconsistent terminology or incomplete information.

Before December 2014, Queensland adjudication applications were generally received and referred by authorised nominating authorities under the former statutory scheme. From December 2014, Queensland applications have instead been received and referred through the Adjudication Registry. Accordingly, a post-December 2014 decision grouped under an ANA does not mean that the ANA received, referred, selected, controlled or influenced the application or its outcome.

3. Attribution and inference

Sopal may identify an ANA affiliation from the text of a published decision or infer an affiliation from the adjudicator’s documented affiliations in other decisions. Automated keyword extraction, artificial intelligence and other analytical processes may be used.

Affiliations may be incomplete, outdated, non-exclusive or incorrect. An adjudicator may be associated with more than one ANA, may change affiliations over time, or may act independently of an ANA. A grouping is an analytical classification only and is not a statement that the ANA appointed, employed, supervised or was legally responsible for the adjudicator in the relevant matter.

4. Statistical limitations

The Statistics are descriptive and approximate. They may be affected by differences in claim value, dispute type, legal issues, complexity, documentation, parties, time period, statutory regime, sample size and the availability or quality of published data.

5. No inference about quality, fairness or causation

The Statistics do not establish or imply that an ANA or adjudicator is favourable or unfavourable to any class of party, biased, unfair, competent or incompetent. They do not measure the quality of reasons, procedural fairness, legal correctness or the suitability of an ANA or adjudicator for a particular dispute.

No causal inference should be drawn between an ANA affiliation and an adjudication outcome. Users must not describe or reproduce the Statistics in a manner that suggests causation, endorsement, misconduct or responsibility that the data does not establish. You agree and acknowledge that you will not draw, act upon or represent to others any such inference.

6. General information only

The Statistics are provided for general information and research only. They are not legal, financial or professional advice and are not a recommendation to select or avoid an ANA, adjudicator or other service provider. You should independently verify material information and obtain professional advice appropriate to your circumstances.

7. Corrections

Sopal welcomes substantiated correction requests from ANAs, adjudicators and users. A request should identify the relevant entry, explain the alleged error and provide supporting material. Sopal may investigate, amend, annotate, suspend or retain an entry in its reasonable discretion. Requests may be submitted through the contact page.

8. Permitted use

You may use the Statistics for your own professional research and internal decision-making, subject to the other Sopal terms. You must not scrape, systematically reproduce, resell or republish a substantial part of the Statistics, remove qualifications or disclaimers, or present the Statistics in a misleading, defamatory or deceptive manner.

9. Availability and changes

Sopal may change its methodology, classifications, thresholds, calculations, labels and source data; correct or remove information; and suspend or discontinue the Statistics. Changes may affect comparisons with earlier versions.

10. Liability and non-excludable rights

To the maximum extent permitted by law, Sopal does not warrant that the Statistics are complete, current, accurate, suitable for a particular purpose or free from error. You are responsible for how you interpret and use them.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. Subject to those non-excludable rights, Sopal’s liability is limited in accordance with the Terms of Use, Account Terms and Subscription Terms.

11. Governing law

These terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and courts entitled to hear appeals from them.
