Adjudicator Insights Terms & Conditions

Important Notice
These Adjudicator Insights Terms & Conditions contain specific terms for the paid Adjudicator Insights service. By purchasing access, you acknowledge and agree to these terms in addition to our general Terms of Service.
1. Introduction
These Adjudicator Insights Terms & Conditions ("Insights Terms") govern your purchase and use of the Adjudicator Insights premium feature on Sopal Australia ("Sopal").
The Adjudicator Insights service provides enhanced analytics, statistics, and decision history for specific adjudicators who have made determinations under the Building Industry Fairness (Security of Payment) Act 2017 (Qld).
2. Incorporation of General Terms
These Insights Terms supplement and form part of Sopal's general Terms of Service. All provisions of the general Terms of Service apply to your purchase and use of Adjudicator Insights, except where expressly modified or superseded by these Insights Terms.
In case of conflict: To the extent of any inconsistency between these Insights Terms and the general Terms of Service, these Insights Terms shall prevail in relation to the Adjudicator Insights service.
3. Service Description
Subject to the balance of these Terms & Conditions, Adjudicator Insights provides access to:
- Comprehensive statistics for a specific adjudicator
- Decision history and patterns analysis
- Aggregated data including average award rates, claim amounts, and fee allocations
- Detailed breakdowns of individual decisions by the adjudicator
- Access to PDF copies of decisions made by that adjudicator
What Adjudicator Insights Does NOT Include
- Legal advice or interpretation of decisions
- Predictions about future decision-making patterns
- Assessment of adjudicator quality or competence
- Access to decisions by other adjudicators (each adjudicator requires a separate purchase)
- Real-time notifications of new decisions
4. Payment and Access
Purchase Terms
- Price: Access to Adjudicator Insights for a single adjudicator costs AUD $54.95 (including GST)
- Payment: Payment is processed securely through Stripe. We do not store your credit card information
- One-time payment: This is a one-time payment for permanent access to that specific adjudicator's insights
- Per-adjudicator access: Each purchase grants access to insights for ONE adjudicator only. Access to other adjudicators requires separate purchases
- Non-transferable: Access is tied to your Sopal account and cannot be transferred to another user
Access and Account Requirements
- You must create and maintain a Sopal account to purchase and access Adjudicator Insights
- You are responsible for maintaining the confidentiality of your account credentials
- Access is provided immediately upon successful payment verification
- Access remains active as long as your Sopal account is in good standing
5. Data Accuracy and Completeness
Critical Disclaimer: No Guarantee of Completeness
While we make reasonable efforts to provide comprehensive data, we make NO guarantee that all decisions by an adjudicator are included in our database or that the data is complete, current, or error-free.
Known Limitations
The Adjudicator Insights data may be incomplete or inaccurate due to:
- Password-protected decisions: Some decisions published by the QBCC may be password-protected or restricted, preventing automated collection
- Corrupted files: PDF files may be corrupted, unreadable, or improperly formatted, making data extraction impossible
- Processing errors: Errors may occur during automated data extraction, parsing, or analysis
- Publication delays: There may be delays between a decision being made and its publication by the QBCC
- Missing metadata: Some decisions may lack complete information (such as claim amounts, dates, or party names)
- Historical gaps: Older decisions may not be available in digital format or may be missing from the QBCC database
- AI extraction errors: Data extracted using AI tools may contain inaccuracies or misinterpretations
- Name variations: Decisions may be attributed to adjudicators under different name formats or spellings
- Void or set aside decisions: Decisions that have been declared void or otherwise set aside by the Supreme Court of Queensland may still form part of the database
User Responsibility
You acknowledge and agree that:
- You must independently verify any information that is important to your purposes
- The statistics and analytics are provided for general informational purposes only
- Missing decisions or incomplete data may materially affect the accuracy of statistics
- You should not rely solely on Adjudicator Insights data for critical decisions
6. Specific Disclaimers
No Assessment of Adjudicators
Sopal does not make, and Adjudicator Insights does not constitute, any representation, warranty, or opinion regarding the quality, competence, fairness, or appropriateness of any adjudicator's decisions or decision-making process.
Interpretation and Use
We expressly disclaim any representation that:
- Statistics or patterns indicate future decision-making behavior
- Higher or lower award rates indicate better or worse adjudicator performance
- The data is suitable for determining adjudicator selection or challenges
- Trends or patterns have any predictive value
- The data reflects the full scope of an adjudicator's work or capabilities
Legal and Professional Advice
Adjudicator Insights:
- Does NOT constitute legal advice or professional opinion
- Should NOT be used as the sole basis for legal strategy or decisions
- Should NOT replace consultation with qualified legal professionals
- Does NOT create any attorney-client or advisory relationship
7. No Warranties or Representations
In addition to the disclaimers in our general Terms of Service, we specifically disclaim all warranties regarding:
Data Quality
- Accuracy: We do not warrant that statistics, figures, or analysis are accurate or free from error
- Completeness: We do not warrant that all decisions are captured or that the dataset is complete
- Timeliness: We do not warrant that data is current or reflects the most recent decisions
- Consistency: We do not warrant that data collection or analysis methods are consistent over time
Fitness for Purpose
We make no representation that Adjudicator Insights is suitable for any particular purpose, including but not limited to:
- Adjudicator selection or nomination processes
- Preparation of legal strategies or submissions
- Assessment of likely outcomes in adjudication proceedings
- Academic or statistical research requiring verified data
8. Attribution Requirements
The underlying adjudication decisions accessible through Adjudicator Insights are public documents originally published by the Queensland Building and Construction Commission (QBCC).
These materials are made available by the QBCC under the Creative Commons Attribution 4.0 International Licence (CC BY 4.0).
Your Attribution Obligations
When using, citing, or sharing information derived from Adjudicator Insights, you must:
- Attribute the original decisions to the Queensland Building and Construction Commission
- Include a link to the CC BY 4.0 licence where practical
- Indicate if you have made any modifications or analysis of the original material
- Not suggest that the QBCC endorses your use of the material
Recommended attribution format: "Based on adjudication decisions published by the Queensland Building and Construction Commission under CC BY 4.0. Analysis and statistics provided by Sopal Australia."
9. Refunds and Cancellations
No Refunds
Due to the nature of digital content that is immediately accessible upon purchase:
- All purchases of Adjudicator Insights are final and non-refundable
- Once payment is processed and access is granted, no refunds will be provided
- This applies even if you change your mind, find the data incomplete, or are dissatisfied with the service
Exceptions
Refunds may be considered only in the following limited circumstances:
- Technical error resulting in payment being charged without access being granted
- Duplicate charges for the same adjudicator on the same account
- Charges made without authorization (subject to verification)
To request a refund under these limited circumstances, contact us at info@sopal.com.au within 7 days of the purchase with your transaction details.
Access Termination
We reserve the right to terminate your access to Adjudicator Insights if:
- You breach these Terms or our general Terms of Service
- We discontinue the Adjudicator Insights service (with reasonable notice)
- Your account is suspended or terminated for any reason
No refunds will be provided in the event of access termination for breach of terms.
